New Data Protection Legislation

Tuesday 5 December 16:18

The Council of Ministers has proposed new data protection laws that will help to strengthen individuals’ rights and ensure that Island businesses remain competitive.

The Data Protection (Jersey) Law 201- and Data Protection Authority (Jersey) Law 201- were lodged today (5 December 2017) and are scheduled to be debated by the States Assembly in January 2018.

The purpose of the new legislation is to:

  • provide equivalent protection to the European Union’s General Data Protection Regulation (‘GDPR’) and Law Enforcement Directive;
  • enhance individuals’ rights;
  • enable data to move freely between Jersey and the European Union.

This legislation will be essential to facilitate trade and ensure that law enforcement authorities in Jersey can continue to cooperate with their colleagues in other jurisdictions.

The Assistant Chief Minister, Senator Paul Routier, said: “Jersey is committed to implementing a data protection regime that meets the needs of Islanders and businesses. By achieving the highest standards on data protection, Jersey’s businesses will continue to enjoy access to international markets.”

If approved by the States Assembly and the Privy Council, the new laws are expected to come into effect on 25 May 2018.
